Terms of Use

These terms apply to briansellsindy.com and the tools that run under it, including value.briansellsindy.com, cash-offer requests, net sheets and single-property pages ("the Sites"), operated by Brian Heaney, a licensed Indiana REALTOR® with Mark Dietel Realty, LLC. By using the Sites you agree to these terms and to the Privacy Policy.

Not an appraisal, not a guarantee

Any home value, value range, net-sheet estimate or cash-offer figure shown on the Sites is an opinion of value prepared from the information you provide, public records and Multiple Listing Service data. It is not an appraisal, and it is not a commitment to buy, list or sell at any price. Values change with the market and with details that can only be confirmed in person. Do not make financial decisions, such as refinancing, pricing a sale or accepting an offer, based on an estimate from the Sites alone. A formal appraisal can only be performed by a licensed appraiser.

Cash offers

Cash offers come from independent investor buyers, not from me or Mark Dietel Realty, LLC. I present them to you alongside an estimate of your net from a traditional listing so you can compare. I do not guarantee that any buyer will make an offer, that an offer will be at any particular price, or that a buyer will close. Any purchase agreement is between you and the buyer. You are free to accept an offer, list with me, or do neither.

No agency relationship until agreed in writing

Using the Sites, requesting a report or receiving offers does not make me your agent. Under Indiana law, an agency relationship is created by a written agreement (a listing agreement or buyer agency agreement). Until then, I may be acting as a limited agent for another party, and information you share with me is handled as described in the Privacy Policy but is not confidential under an agency relationship.

Not legal, tax or financial advice

I am a real estate licensee, not an attorney, accountant or financial advisor. Content on the Sites about divorce, inheritance, foreclosure, taxes, landlord-tenant matters or similar topics is general information for Indiana and may not apply to your situation. Consult the appropriate professional before acting on it.

Listings and MLS data

Property information is deemed reliable but is not guaranteed and should be independently verified. Listing data may come from the MIBOR Broker Listing Cooperative® and is provided for consumers' personal, non-commercial use to identify properties they may be interested in purchasing. It may not be copied, redistributed or used for any other purpose. Nothing on the Sites is intended to solicit a property currently listed with another broker.

Your use of the Sites

• Provide accurate information about yourself and your property.
• Submit requests only for a property you own or are authorized to act for.
• Do not scrape, copy, probe, overload or interfere with the Sites, and do not submit spam or automated requests.
• Content, design and code on the Sites belong to me or my licensors and may not be reused without permission.

Communications

When you submit a form with the consent box checked, you agree to be contacted as described in the Texting Terms. You can withdraw that consent at any time.

Links and third parties

The Sites link to third-party services such as Google, lenders and government resources. I do not control them and am not responsible for their content or practices.

Limitation of liability

The Sites are provided "as is". To the fullest extent permitted by Indiana law, Brian Heaney and Mark Dietel Realty, LLC are not liable for any loss arising from use of the Sites or reliance on an estimate, including lost profits or the difference between an estimate and an actual sale price. Nothing in these terms limits duties I owe you under a signed agency agreement or under Indiana license law.

Governing law and changes

These terms are governed by the laws of the State of Indiana. I may update them from time to time; the "last updated" date above will change when I do, and continued use of the Sites means you accept the current version.
