Privacy Policy

This policy covers briansellsindy.com and the tools that run under it, including the home-value report at value.briansellsindy.com, cash-offer requests, net sheets and single-property pages ("the Sites"). The Sites are operated by Brian Heaney, a licensed Indiana REALTOR® with Mark Dietel Realty, LLC ("I", "me"). By using the Sites you agree to this policy.

What I collect

• Contact details you give me: name, email address, phone number, and anything you type into a form or message.
• Property details you give me: address, size, condition, updates, timeline, mortgage status, and the situation you select on a cash-offer page.
• Consent records: the exact consent text you agreed to, the date and time, the page it came from, and your IP address. I keep these as proof of your permission to contact you.
• Usage data: the pages you visit, the link or campaign that brought you here, your browser type and approximate location derived from your IP address. The Sites do not use third-party advertising cookies.
• Public records and MLS data: to prepare a value report or net sheet I combine what you tell me with county assessor records, recorded sales and Multiple Listing Service data.

How I use it

• To prepare what you asked for: a home-value report, a cash-offer comparison, a net sheet, buyer alerts, or an answer to your question.
• To follow up about your request by phone, text or email, with your consent (see Texting Terms).
• To send occasional market updates or home-value check-ins if you asked for them. Every email includes an unsubscribe link, and every text accepts STOP.
• To keep the Sites secure, prevent spam and abuse, and understand which pages are useful.
• To meet record-keeping duties under Indiana real estate licensing law and my brokerage's policies.

Who sees it

• My brokerage. Indiana licensees work under a managing broker. Mark Dietel Realty, LLC may access lead and transaction records as required by license law and brokerage policy.
• Investor buyers, cash-offer requests only. When you request cash offers, I share your property details and your contact information with investor buyers in my network so they can evaluate the home and make offers. Those buyers may contact you directly. They are independent businesses with their own privacy practices; I share your information only with buyers I have worked with and only for the purpose of getting you offers. You can withdraw at any time by telling me, and I will stop sharing it.
• Service providers that run the Sites: web hosting and security (Cloudflare), application hosting (Render), database hosting (MongoDB Atlas), email delivery (Google), address lookup (OpenStreetMap-based geocoding, which receives the address text you type), and a business phone and texting service. They process data on my behalf and may not use it for their own marketing.
• Transaction parties, if you hire me: title companies, lenders, inspectors, the other side's agent, and anyone else needed to close a sale, as you direct or as the transaction requires.
• Legal requirements: if a court, regulator, or the Indiana Real Estate Commission requires it.

I do not sell your personal information, and I do not share your mobile phone number or your texting consent with third parties for their own marketing. Sharing with investor buyers happens only when you request cash offers and is disclosed on that form.

Texting Terms (SMS program)

Program: Brian Heaney, REALTOR® (Mark Dietel Realty, LLC) home-value, cash-offer and buyer-alert follow-up.

• How you opt in: by checking the consent box on a form on the Sites, by texting me first, or by asking me to text you. Consent is not a condition of buying or selling a home or of any other purchase.
• What you'll get: replies about your request, your value report or offers, appointment confirmations, and occasional market updates if you asked for them. Message frequency varies; typically a few messages around your request and no more than a few per month afterward.
• Cost: message and data rates may apply according to your carrier plan. Carriers are not liable for delayed or undelivered messages.
• Opt out: reply STOP at any time to any message and you will receive one confirmation and nothing further. You can also email or call me using the contact details below.
• Help: reply HELP for assistance, or contact me at (317) 995-2372 or briansellsindy@gmail.com.
• Privacy: mobile numbers and opt-in data are used only for this program and are not shared with third parties or affiliates for marketing purposes.

Email

Marketing and follow-up emails come from me, identify Mark Dietel Realty, LLC, include my mailing address (PO Box 4450, Carmel, IN 46082), and carry a working unsubscribe link. Opt-outs are honored within ten business days, usually immediately. Emails you send me about a transaction are kept with the transaction file.

Cookies and analytics

The Sites use only the cookies needed to run them (for example, a session cookie if you sign in to a client portal, and security cookies set by Cloudflare). Any tracking parameters on links you click (such as utm codes) are stored with your inquiry so I know which page or campaign you came from. No advertising networks place cookies here.

How long I keep it

Lead and consent records are kept for as long as I may need to show that I had permission to contact you, and at least as long as Indiana license law requires for transaction records (currently five years after closing). Usage logs are kept for a short period for security. You can ask me to delete your information at any time; I will do so unless I am required to keep it.

Your choices

• Ask what information I hold about you, correct it, or ask me to delete it.
• Withdraw consent to calls, texts or emails at any time; STOP and unsubscribe links work immediately, and you can also just tell me.
• Ask me to stop sharing your cash-offer request with investor buyers.

To make any request, use the contact details below. I will respond within 30 days and may ask you to verify your identity.

Security

The Sites are served over HTTPS, form submissions are validated and rate-limited, data is stored with access-controlled providers, and account access to my lead system requires a password and is logged. No system is perfectly secure, so please do not send Social Security numbers, bank details or other sensitive identifiers through the Sites; a title company or lender will collect those through their own secure channels when needed.

Children

The Sites are intended for adults. I do not knowingly collect information from anyone under 18.

Changes

If this policy changes in a meaningful way, the "last updated" date above will change and, where consent is affected, you will be asked again. Continued use of the Sites after a change means you accept the updated policy.
